Government Promotes Alternative Dispute Resolution Mechanisms
The Government of India is actively promoting the use of alternative dispute resolution (ADR) mechanisms such as arbitration and mediation. Through amendments to key legislation like the Arbitration and Conciliation Act and the establishment of institutions such as the India International Arbitration Centre, the Government aims to provide less adversarial and quicker methods for dispute resolution. Legislative initiatives like the Mediation Act, 2023 and the Commercial Courts Act, 2015, which includes the Pre-Institution Mediation and Settlement mechanism, further bolster India's ADR framework. Moreover, Lok Adalats contribute to a quicker and less costly justice system where awards are binding and final.
