Supreme Court Urges Review of Tribal Property Rights under Hindu Succession Act
The Union Minister of State for Tribal Affairs, Shri Durgadas Uikey, highlighted in Rajya Sabha that the Ministry of Law & Justice needs to review the applicability of the Hindu Succession Act to Scheduled Tribes. This follows a Supreme Court judgement in the case Kamla Neti (Dead) through LRs Vs. The Special Land Acquisition Officer and Ors., which dismissed the appeal but urged the Central Government to consider whether exceptions for Scheduled Tribes under the Act should be reconsidered, aiming to enhance equality as per the Indian Constitution.
